ICASA publishes regulations are made in terms of Section 60 of the Electronic Communications Act which calls on the Authority to prescribe regulations regarding the extent to which subscription broadcast services must carry, subject to commercially negotiable terms, television programmes provided by a public broadcast service licensee. The IBA Act had no provisions on the “must carry” regulations, and the Electronic Communications Act of 2005 (ECA) plugs this gap by requiring ICASA to prescribe regulations, and to
amend the Subscription Broadcasting Services Regulations.
